I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life.



這是Sonia Sotomayor(美國第一位拉丁裔、第三位女性大法官)在2001年於柏克萊演講時的一段話。在獲得Obama提名之後,這些公開言論(以及她的反種族歧視法律實踐經驗)使得她蒙受種族主義者(racist)的批評,迫使她在國會聽證時必須「澄清」,雖然生命經驗形塑了一個人,但是法官終究必須完全依循法律,不論其個人背景為何。身分、經驗與客觀性之間的關係為何?正義是否意味著無視差異的不偏不倚?

本學期的英美法學名著選讀,將帶領同學們透過批判種族理論(critical race theory, CRT)的經典文獻,來思考身分/認同(identity)、經驗(experience)、立場(standpoint)與法學知識的關係,特別是客觀性(objectivity)。因此,這將是一門顛覆法學正典想像的法學名著選讀課程。選讀文獻的標準,不求艱深難解,更不在意作者是否為國內所熟知的大師,而重視文獻所承載的知識及其作者在批判種族理論運動中所扮演的關鍵性角色,並且也著重作者與文本之間被表明的關係,也就是作者在文本中的現身。從女性主義立場論(feminist standpoint theory)的觀點來看,知識生產者的立場是重要的,而身分雖不決定立場、但往往攸戚相關。強調「立場」與「知識」之間緊密關係的Sandra Harding便主張,「誰來說」、「說了什麼」、「何時說」是有意義的(it does matter who says what and when)。女性主義立場論並不主張立場「決定」了知識,而是要強調知識的脈絡性、以及被壓迫的立場較有利於生產有關壓迫以及挑戰壓迫的知識,並且主張多元立場與在地知識,可以創造強而有力的客觀性(strong objectivity)。後殖民女性主義者Gayatri Chakravorty Spivak也曾表示,當只有男人能夠理論化女性主義,只有白人能夠理論化種族主義,只有布爾喬亞能夠理論化革命的時候,這是政治上不可忍受的。因此,批判種族理論的學者們固然不乏白種菁英男性,但本學期的文獻選讀沒有英美白種男人的作品,而將聚焦在重要的「有色人種」學者。這並非是在揭露「法學名著」未被明言的正統作者種族與性別身分之後,將白種男人的作品一概本質主義地排除在外的復仇行動,而是試圖挪移我們的焦點,並且重新定義法學名著。

習得閱讀以及搜尋英文文獻的能力,以及批判種族理論的知識 
課程要求
本課程非常重視同學上課的報告和參與討論,此部分占學期成績之50%。每週負責報告的同學,必須以Powerpoint的方式呈現、於前一日將報告檔案上傳至課程網站,其餘同學則應於課程網站之討論區提出至少兩個(經仔細閱讀該週文本後所產生的)有意義的問題。學期報告為翻譯的習作,占學期成績之50%。

本課程非常重視同學上課的報告和參與討論,此部分占學期成績之50%。輪值報告同學,必須於提供報告大綱,整理該週閱讀文獻之重點、以及提問,該份報告大綱應於上課之前一日(即週三)下午六點之前,發表於Ceiba課程網上本課程之討論區。其他同學則應於同一時間前,於討論區發表對於該週閱讀文獻之提問(至少兩個)。

期末報告 
50% 
學期報告占50%。學期報告是翻譯的習作,這不只是語文能力的練習,更希望同學們可以藉由翻譯來思考翻譯的不確定性,以及翻譯者不被明言的作者身份。對於翻譯的檢討,請同學們拜訪翻譯工作坊(http://sts.nthu.edu.tw/transws/index.php),特別是閱讀傅大為老師的「打開翻譯潘朵拉盒子─從翻譯書的認識論到大學教育中的翻譯書」,當代167:44-57(2001)。翻譯習作的撰寫方式為選擇本學期一篇閱讀文獻之局部(約10頁)進行全文翻譯,並說明何以選擇該份文獻、何以選譯該部分,以及翻譯心得。
